PATENTS
In Costa Rica, patent applications can be filed as a national patent, or claiming priority based on the Paris Convention or on the Patent Cooperation Treaty.
Patent protection lasts 20 years, which will be counted from the date of filing of the patent application in its country of origin.
The validity of the patent is subject to evidence that the invention is exploited in Costa Rica on a permanent and stable basis. Otherwise, the patent will be subject to compulsory public license or the patent grant will be terminated.
The Costa Rican Patent Law establishes that annuities must be paid.
INDUSTRIAL DRAWINGS
Industrial Drawings can be protected for a term of 10 years, which will be counted from the date of registration in Costa Rica.
UTILITY MODELS
Utility models can be protected for a term of 10 years, which will be counted from the Costa Rican filing date.
